Case Brief: Gyani Samsher Singh, head priest at Sikh temple Jakarta, Indonesia had applied for visitor visa to visit his adult kids who were studying and working in Canada. His Visa application was refused and further was put on ban for a period of 5 years, due to some misrepresentation in his visa application. He approached me for assistance and guidance, and since we stay in Indonesia it was difficult to take this forward. Through one of the immigration consultant I came to know about Mr Makkar. I spoke to him over phone during November 2022 and based on his knowledge and advise, we decided to proceed with judicial review on visa application in Federal Court of Canada. Legal Process: During the entire process of judicial Review, Mr. Makkar guided us from A – Z and in dealing with him we found that he is one of the most genuine and knowledgeable immigration lawyer. The entire legal process took almost 1 year and went through several phases of ups and down, which was not easy to deal with as we stay in different Geographical region with time difference of 13 hours. I had Immigration Admissibility Hearing as an International Student, January 26, 2021, which the result was negative. My cousin and I met Mr Harsimran Makkar, January 28, 2021, when I was facing exclusion order from Canada. I was given another opportunity to meet with the CBSA officer with my counsel for my PRRA application or a removal arrangement. My PRRA application was refused based on insufficient documents, October 14. 2021, because we had limited time to submit the application. I met with the Enforcement Officer at the CBSA office for my Direction to Report, I was schedule to leave Canada, January 11, 2022. The last option we had was to apply for Application for Leave and Judicial Review and Stay Motion all at Federal Court which was submitted, December 19, 2021, and December 23, 2021, respectively by Mr Harsimran Makkar. December 30, 2021, I had a call from Mr Harsimran Makkar, “Ken, one of our Respondent has sent an email stating that, 1. The decision dated October 14, 2021, is to be set aside. 2. The matter is to be re-determined by a different officer. 3. The processing office will grant the Applicant an opportunity to make additional submission and 4. No cost to either party. A year ago, I shared my story above and am here again to continue. I was ask to report at the Enforcement and Intelligence Operation Division on Wednesday, October 11, 2023 by Canada Border Service. A decision has been rendered with respect to my application. My Pre - Removal Risk Assessment (PRRA) has been allowed, and I can go ahead and apply for Permanent Resident Status I strongly recommend Mr Harsimran Makkar, for his excellent services, he pays attention to minute details, he is a good communicator and his skills at work is exceptional.
